The two main categories for crimes are felonies and misdemeanors. Most people know the severity of felony charges, but it can be hard to understand the seriousness of misdemeanors and their consequences. Here is a breakdown of the impact and consequences of misdemeanor charges in Texas.

Classes of Misdemeanors

There are three classes of misdemeanor crimes: Class A, Class B and Class C. Class A misdemeanors are the most severe, and Class C are considered the least severe.

Class A

These are crimes punishable by up to one year in jail or a fine of up to $4,000. In some cases, you will be expected to serve both jail time and pay the fine. Carrying firearms without a permit and burglarizing a vehicle are considered Class A misdemeanors. These are serious crimes, but they don’t involve violence.

Class B

Class B misdemeanors can be met with 180 days in jail and up to $2,000 in fines. Possession of drugs, such as less than two ounces of marijuana, is considered a class B misdemeanor.

Class C

Class C misdemeanors ware not punishable by jail time, but the guilty party will be faced with fees up to $500. Shoplifting of items less than $100 in value is considered a Class C misdemeanor.

Sentencing Conditions

Depending on someone’s criminal record, their misdemeanor charges will be handled differently. For instance, someone who has been charged with a Class A misdemeanor in the past and is a repeat offender must serve a mandatory minimum of 90 days in county jail. Class A misdemeanors involving drugs or controlled substances are served with a mandatory minimum of 180 days in jail. The same goes for crimes believed to be committed with bias or prejudice.

Common Examples

The qualifying factors of misdemeanors differ between states. In Texas, things like petty theft, first time DWI offences and disorderly conduct are considered misdemeanors. Possession of small amounts of drugs and certain weapons might also be misdemeanors.

Although some of these crimes can start as misdemeanors, depending on the offender’s history and levels of damage or loss, they can escalate to felony status.
